Are Warrants Public Information in Missouri?

Missouri's Sunshine Law (RSMo § 610.011) declares that all public records of public governmental bodies are open to the public for inspection and copying. The law sets an aggressive response timeline: under § 610.023.3, a custodian of records must act on a request no later than the end of the third business day following receipt. This is among the shortest mandatory response windows in the country. If the records cannot be produced by that deadline, the custodian must provide a detailed written explanation and a specific date when the records will be available.

The Sunshine Law's treatment of law enforcement records, however, is layered. RSMo § 610.100 separates law enforcement records into three categories with different disclosure rules:

  • Incident reports — documenting the initial report of a crime — are open records at all times.
  • Arrest reports — documenting an arrest and the charge — are open records, but only if the person was charged within 30 days. If no charge is filed within 30 days of arrest, the arrest report becomes a closed record.
  • Investigative reports — everything else prepared by law enforcement in connection with a criminal investigation — are closed records until the investigation becomes inactive. An investigation becomes inactive when the agency drops the case, the statute of limitations expires, or all convictions become final on appeal.
