Are Court Records Public in Greene County?
Most court records generated in Greene County are public records. Missouri’s Sunshine Law (Chapter 610, RSMo) establishes a presumption of openness for records maintained by government bodies, including courts. The law requires that public agencies release records upon request from eligible parties, and exceptions to public access are interpreted narrowly.
However, several categories of court records are restricted or confidential under state law and court rules. Records that may be withheld from public disclosure include:
- Sealed records — Cases placed under seal by court order are not accessible to the public
- Expunged records — Criminal records that have been expunged pursuant to Missouri statute are closed to public inspection and require a court order to reopen
- Juvenile records — Proceedings involving minors in juvenile court are generally confidential under Chapter 211, RSMo
- Adoption records — Adoption files are sealed and restricted to authorized parties
- Orders of protection — Certain details in adult and child abuse protection order cases may be restricted
- Redacted information — Under § 509.520, RSMo, and § 595.226, RSMo, personally identifying information such as Social Security numbers and victim information may be redacted from publicly accessible documents
The Circuit Clerk’s office notes that some case types require photo identification to obtain copies, and the office cannot release requested documents to third parties — third parties must file their own request directly. The privacy statement on the Circuit Clerk’s website details how the office handles records under the Sunshine Law. Court clerks are also prohibited from providing legal advice under Supreme Court Operating Rule 25.
