Are Court Records Public in Warren County?
Missouri’s framework for public access to court records flows from the Missouri Sunshine Law, Chapter 610 of the Revised Statutes of Missouri. Under this statute, most records held by public governmental bodies — including courts — are presumptively open to the public. Importantly, a requester does not need to state a reason or purpose when seeking public records under Missouri law.
Records generally accessible to the public include:
- Circuit Court civil case filings, judgments, and orders
- Criminal case records, including charges, verdicts, and sentencing
- Probate petitions, estate inventories, and guardianship orders
- Domestic relations filings, including divorce decrees
- Property records held by the Recorder of Deeds
- Marriage licenses and certified copies
Records that may be withheld under RSMo § 610.021 include:
- Records subject to attorney-client privilege in ongoing government litigation
- Welfare case records of identifiable individuals
- Records sealed by court order or protected by separate statute
- Juvenile court records — Confidential under RSMo § 211.321, which restricts disclosure of records from juvenile court proceedings; access requires a court order or demonstrated legitimate interest
- Security credentials, including digital certificates, access codes, and personal identification numbers used in electronic government transactions
Requests for restricted records generally require the requester to demonstrate a valid legal interest, and in some cases, a court order is necessary before records will be released.
